These Terms and Conditions govern your purchase of any e-Book from Airé Libré Publishing & Computing Ltd. By completing the purchase of an e-Book from Airé Libré Publishing & Computing Ltd., you agree to be bound by the terms of this Agreement.

• 1. License: All Rights of this work are reserved. No part or whole may be used, copied or reproduced, stored in retrieval systems other than on your one reader, or transmitted, in any form or by any means whatsoever, including electronic media, mechanical, photocopying, recording, or otherwise.

  The Copyrights and Trademarks for The Ole’ Man ‘n The Horses, Looking Into The Horse’s Heart and The Circles Of Influence, books in print and e-Books, and all other media, are registered to Seven Rays Emprises Inc., of which Airé Libré Publishing & Computing Ltd. is and agent and assignee.

  You agree to be bound by the terms of this License. Airé Libré Publishing & Computing Ltd. agrees to grant, and the user of the e-Book agrees to accept, a nonexclusive license to use the e-Book under the terms and conditions of this Agreement. Your use of the e-Book constitutes your agreement to the terms and conditions set forth in this Agreement. This Agreement, or any part thereof, cannot be changed, waived, or discharged other than by a statement in writing signed by you and Airé Libré Publishing & Computing Ltd.

  Please read the entire Agreement carefully.

• 2. E-Book Usage: The e-Book may be used by one user on one computer, or reader. The user of the e-Book shall be subject to all of the terms of this Agreement, whether or not the user was the purchaser.

• 3. Usage Enforcement: Airé Libré Publishing & Computing Ltd. retains the right to enforce our e-Book Usage, as stipulated and various Digital Rights Management rights through various mechanisms, including the use of software and web access. Under certain circumstances this might mean you will not be able to access the e-Book if you do not have a web access. You agree that in all circumstances, you accept all mechanisms by which we enforce our rights, including all ramifications of such. You further agree that

• 3.1. Any failure through errors and omissions, bugs and/or defects, etc. of our rights-enforcement mechanisms, to halt any use you make of our e-Books that is contrary to this Agreement, does not constitute a waiver of any part of this Agreement, and specifically does not constitute a granting of any additional rights; and that

• 3.2. If Airé Libré Publishing & Computing Ltd. should, in our sole discretion, decide to grant a temporary waiver of any of the stipulations of this Agreement that does not constitute a granting of any additional rights.

• 4. Copyright, Use and Resale Prohibitions: Airé Libré Publishing & Computing Ltd. retains all rights not expressly granted to you in this Agreement. The software, content, and related documentation in the e-Book are protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. Nothing in this Agreement constitutes a waiver of Airé Libré Publishing & Computing Ltd's rights. Airé Libré Publishing & Computing Ltd. will not be responsible for performance problems due to circumstances beyond its reasonable control. You may not copy, print, modify, remove, delete, augment, add to, publish, transmit, sell, resell, license, create derivative works from, or in any way exploit any of the e-Book’s content, in whole or in part, in print or electronic form, and you may not aid or permit others to do so. The unauthorized use or distribution of copyrighted or other proprietary content is illegal and could subject the purchaser to substantial damages. Purchaser will be liable for any damage resulting from any violation of this Agreement.

• 5. No Transfer. This license is not transferable.

• 6. Liability Limitation: The e-Book is provided “as is” and Airé Libré Publishing & Computing Ltd. does not make any warranty or representation, either express or implied, to the e-Book, including its quality, accuracy, performance, merchantability, or fitness for a particular purpose. You assume the entire risk as to the results and performance of the e-Book, and its content. Airé Libré Publishing & Computing Ltd. does not warrant, guarantee, or make any representations regarding the use of, or the results obtained with, the e-Book in terms of accuracy, correctness or reliability. In no event will Airé Libré Publishing & Computing Ltd. be liable for indirect, special, incidental, or consequential damages arising out of delays, errors, omissions, inaccuracies, or the use or inability to use the e-Book, or for interruption of the e-Book, from whatever cause. This will apply even if Airé Libré Publishing & Computing Ltd. has been advised that the possibility of such damage exists. Specifically, Airé Libré Publishing & Computing Ltd. is not responsible for any costs, including those incurred as a result of lost profits or revenue, loss of data, the cost of recovering such programs or data, the cost of any substitute program, claims by third parties, or similar costs. In no case will Airé Libré Publishing & Computing Ltd’s liability exceed the amount of license fees paid, as they were the purchase price of the e-Book, at the time of purchase.

• 7. Hold Harmless and/or Indemnification: You agree to defend, indemnify, save and hold Airé Libré Publishing & Computing Ltd. and any third party provider harmless from and against all third party claims and damages, including reasonable attorneys’ fees, regarding your use of the e-Book.

• 8. Jurisdiction: You agree that by conducting business with Airé Libré Publishing & Computing Ltd., any legal action resulting from any transaction will be governed by the laws of the Province of British Columbia, Canada; and You agree to reimburse us or any representative we may appoint for any legal expenses your actions may cause us to incur.

• 9. Return Policy: This is an e-Book, a version which is free of DRM. All sales are final, as it impossible to return the e-Book, nor is it possible to monitor the Purchaser computer and reader equipment.
